These General Terms and Conditions regulate the business relations between juslingua<\/i><\/b> AG<\/strong><\/em> and its clients in the fields of interpreting, translation and proofreading, editorial editing of texts and any other language services.<\/p>

2. Order placement<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Following the confirmation of order on behalf of the client, the order is deemed to have been placed. The client thereby accepts the general terms and conditions of j<\/strong>uslingua AG<\/strong><\/em>. Upon placing an order, the client informs juslingua AG<\/strong><\/em> of the desired form of execution of the language service. Information and documents (glossaries, illustrations, abbreviations, etc.) must be provided by the client when placing the order, otherwise abbreviations will be left in their existing form. juslingua AG<\/strong><\/em> accepts no responsibility regarding the authenticity of the documents which are the subject of the order.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

3. Calculation bases and terms of payment<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Translation services are calculated on the basis of standard pages consisting of 1’800 characters (including spaces). The price for translations depends on the scope, degree of difficulty, area of expertise, language group, intended use and delivery deadlines. A surcharge of up to 100% may be charged for short-term orders, depending on the scope and delivery date. Special services such as courier delivery, express postage etc. will be invoiced separately. Additional services such as formatting, data conversion, desktop publishing etc. will be invoiced separately on a time and material basis.
<\/b><\/p>

Unless otherwise agreed, quoted prices shall be considered as recommended prices. Billing is based on the number of characters in the target language calculated by computer. Deviations from the quoted price generally do not exceed 20%. All prices are exclusive of VAT. <\/span><\/p>

juslingua<\/i><\/b> AG<\/strong><\/em> may request prior payment in full before providing services and\/or may demand advance payment particularly for substantial translation work.<\/span><\/p>

Unless otherwise agreed, the client must pay the invoiced price plus VAT within 30 days of the invoice date.<\/span><\/p>

Following the expiry of the payment period, the client shall fall into arrears without reminder, and juslingua<\/i><\/b> AG<\/strong><\/em> shall have the right to apply a late payment interest of 5% on overdue payments.<\/span><\/p>

The applicable or quoted rates are part of the General Terms and Conditions.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

4. Execution and delivery<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The translation shall be carried out pursuant to the principles of proper professional practice. Where the client has not enclosed any documents, technical terms shall be translated into a generally understandable version.
<\/b><\/p>

If the client makes addendums or modifications to the source text after having placed his order, the permissible excess of 20% of the quote shall not apply. Amendments shall be made at the agreed price per page; the additional expenditure caused by changes shall be charged at the agreed or customary hourly rate. <\/span><\/p>

juslingua<\/i><\/b> AG<\/strong><\/em> may use its own employees or third parties (agents) to provide the services.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

5. Client\u2019s defect-related rights\n<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

juslingua<\/i><\/b> AG<\/strong> <\/em>is not responsible for any deficiencies in the translation caused by illegible, linguistically defective, incorrect or incomplete text templates or by non-existent client terminology. <\/b>After delivery of the translation, the client must verify it and inform juslingua AG of any defects.<\/span><\/p>

If the client notifies juslingua<\/i><\/b> AG<\/strong><\/em> of an objectively existing, not inconsiderable defect in the translation, the client shall be entitled to have this rectified by juslingua<\/i><\/b> AG<\/strong><\/em>. The client must assert his right to rectification in writing immediately, but no later than 30 days after delivery, stating the exact nature of the defect. juslingua AG shall be granted a reasonable period of time for rectification. <\/span><\/p>

6. Delivery periods<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

juslingua<\/i><\/b> AG<\/strong><\/em> sees it as an essential part of the services offered to meet the agreed delivery deadlines. Delivery times are agreed upon once the order is placed and are binding. Delay cannot be claimed if the delivery is not made due to a circumstance for which juslingua<\/i><\/b> AG<\/strong><\/em> is not responsible. In the case of substantial and subsequent content changes on the part of the client, juslingua<\/i><\/b> AG<\/strong><\/em> shall be granted a reasonable extension of the deadline. In the event of force majeure, juslingua<\/i><\/b> AG<\/strong><\/em> may demand a reasonable extension from the client. Claims for damages by the client are excluded.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

7. Privacy \/ Data protection\n<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

juslingua<\/i><\/b> AG<\/strong><\/em> undertakes to treat all information and documents provided by the client in connection with the order confidentially and to use them exclusively for the provision of services. The agents used for the provision of the services are obliged by juslingua<\/i><\/b> AG<\/strong><\/em> to keep the client data confidential. At the client’s request, a special non-disclosure agreement may be issued between the client and the agents.
<\/b><\/p>

Unless expressly instructed to the contrary, juslingua<\/i><\/b> AG<\/strong><\/em> assumes that the client agrees to the unencrypted electronic transmission of services and client data via the Internet. The client bears the associated data protection and data loss risk. <\/span><\/p>

juslingua<\/i><\/b> AG<\/strong><\/em> assumes that the client has the intellectual property rights to the source texts necessary for the execution of the services and that these rights are granted to juslingua<\/i><\/b> AG<\/strong> <\/em>to the extent necessary for the execution of the services.<\/span><\/p>

The client has the right to use the translation only once payment has been made in full. The copyright to the translation remains with juslingua<\/i><\/b> AG<\/strong><\/em>. <\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

A termination on the part of the client is only permitted for important reasons and must be done in written form. In this case juslingua<\/i><\/b> AG<\/strong><\/em> is entitled to compensation in the amount of the work already done.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Swiss law shall apply to the contractual relationship between the client and juslingua<\/i><\/b> AG<\/strong><\/em> and to all claims arising therefrom. The exclusive place of jurisdiction shall be the registered office of juslingua<\/i><\/b> AG<\/strong><\/em> in Zurich.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
